Information obligations under Articles 13 and 14 DSGVO

A. General information.

The responsible body for www.stf-placement.de is: STF Placement GmbH, Wierlings Esch 14, 48249 Dülmen (“STF”) represented by the management. The data protection officer for the STF group of companies is available to you at datenschutz@stf-gruppe.de .

What does the STF do with my personal data?

The STF processes the personal data covered by this data protection declaration exclusively as described herein. Further information can be found in sections B and C below. Where the processing of your personal data is based on a statutory authorisation, Section B below contains information on which personal data the STF processes or uses for which purposes. If your consent is required for the processing of your personal data, you will find further information in Section C below.

How long does the STF process personal data?

Insofar as STF processes and uses your personal data on the basis of a statutory authorisation (see Section B below) or within the scope of your consent (see Section C below), STF will only store your personal data for as long as the purposes set out below so require (in the case of permanent positions, the deletion of the transferred data will take place at the earliest 7 months after the end of the application procedure in the event of rejection or negative notification of your application). This does not apply if legal provisions prevent the deletion or if further storage is necessary for the purpose of presenting evidence or if you have agreed to a longer storage), or until you object to the use of your personal data by STF (if STF has a justified interest in the use of your personal data) or until you revoke your consent (if you have agreed to the use of your personal data by STF). However, if STF is required by law to store your personal data for a longer period or if STF requires your personal data to assert legal claims or to defend itself against legal claims, STF will store your personal data until the expiry of the relevant retention period or until the claims have been settled.

If your application is followed by the conclusion of a contract, your data may be stored and used for the purpose of the usual organisational and administrative process in compliance with the relevant legal regulations. Of course, you have the right to withdraw your application at any time.

Why do I have to provide personal data?

In principle, the granting of consent or the provision of personal data hereunder is completely voluntary. If you do not give consent or provide any personal data, this will generally not have any adverse effects on you. However, there are situations in which STF cannot act without certain personal data, for example because this personal data is required to comply with your request to contact us via our contact form. In such cases, STF will unfortunately not be able to provide you with the requested information without the relevant personal data.

Where are my personal data processed?

The STF Group processes the data within the group’s affiliated companies and external service providers both within and outside the European Economic Area (‘EEA’). As a result, whenever STF uses or otherwise processes your personal data for the purposes described in this Privacy Policy, it may transfer your personal data to countries outside the EEA, including countries where there is a level of data protection that is not comparable to the level of data protection within the EEA. Such a transfer will then be subject to the standard contractual clauses in accordance with EU Commission Decision 2010/87/EU or its successor in order to contractually ensure the protection of your personal data by a level of protection applicable in the EEA.

Rights of the persons concerned:

You can obtain information from STF at any time about which personal data STF processes about you and request that this personal data be corrected or deleted. Please note, however, that the STF may only delete your personal data if there is no legal obligation to retain it or if the STF does not have a primary right to retain it.

If the STF uses your personal data on the basis of your consent or to implement a contract with you, you may also request from the STF a copy of the personal data you have provided to the STF. Please send your request to the e-mail address below, specifying the information or processing activity to which your request relates, the format in which you would like this information to be sent, and whether the personal data should be sent to you or to another recipient. The STF will carefully examine your request and clarify with you how it can best be fulfilled.

You may also request STF to restrict the further processing of your personal data in the following cases:

  • If you claim that the personal data about you held by the STF is false (but only for as long as it takes the STF to verify the accuracy of that personal data),
  • If there is no legal basis for the processing of your personal data by the STF and you request that your personal data no longer be further processed by the STF,
  • If STF no longer needs your personal data, but you claim that STF must retain this data so that you can assert or exercise legal claims or defend against claims by third parties, or
  • If you object to the processing of your personal data by the STF (based on the legitimate interest of the STF as described in Section B below), as long as the examination of a overriding interest of the STF in the processing of your personal data or a statutory retention obligation requires.

Right of appeal (pursuant to Article 77 DSGVO in conjunction with § 19 BDSG):

If you believe that STF is not processing your personal data in accordance with the requirements described herein or with data protection laws applicable in the EEA, you may at any time file a complaint with the data protection authority in which you reside or with the data protection authority of the country or state in which STF has its registered office. B. Where does the STF use my personal data on the basis of a statutory basis for permission (basis for contract fulfilment according to Art. 6 para. 1 letter b DSGVO)?

In the following cases, the STF is permitted to process your personal data in accordance with the applicable data protection laws.

Initiation of a business relationship

Here: Employment in a company of the STF Group – including application processing. By activating the checkbox, you expressly agree that STF Placement GmbH may collect, process and use the data you provide to us for the purpose of processing your application. Your data will only be transmitted if you have confirmed your consent by activating the checkbox. The processing and storage of data may be necessary, for example, to establish, change and process business relationships with customers. We then use this data to the extent necessary so that we can comply with our rights and obligations arising from the business relationship.

Transfer of your personal data to other companies within the STF Group:

STF may transfer your personal data to other companies of the STF Group. An up-to-date list of the STF Group companies can be found in Section A under Responsible parties. In the event of a transfer, these companies will use your personal data for the same purposes and under the same conditions as described in sections B and C.

Preparation of statistics (basis: legitimate interest according to Art. 6 para. 1 f DSGVO):

In addition, we would like to point out that the data you provide may be used to compile statistics on the (online) application process. These statistics are compiled exclusively for our own purposes and are in no case personalised, but in anonymous form.

Information on special categories of personal data:

We expressly draw your attention to the fact that applications, in particular CVs, certificates and other data transmitted to us by you, may contain special categories of personal data such as mental and physical health, racial or ethnic origin, political opinions, religious or philosophical convictions, membership of a trade union or political party or sexual life. If you provide us with such information in your online application, you expressly agree that STF Placement GmbH may collect, process and use this data for the purpose of processing your application. This data is processed in accordance with this data protection declaration and other relevant legal regulations.

This may include taking the necessary steps before concluding a contract, answering your related questions and answering any queries our employees may have.

The STF may use your email address to notify you of changes in the application process and to send legally required notices and other notices. In general, users may not opt out of receiving such information, which is not marketing related but only necessary for the particular business relationship. With respect to marketing-related types of communications (i.e., e-mails and telephone calls), STF will (i) where required by law, not provide such information to you until you have given your consent and (ii) provide you with an opportunity to opt out of receiving further marketing-related types of communications. You may object at any time, free of charge, at datenschutz@stf-gruppe.de .

Right to object (basis Article 21 DSGVO):

You can object to the use of your personal data for the purposes described above at datenschutz@stf-gruppe.de . In this case, STF will discontinue and remove from its systems the future use of your personal data for the purposes listed above (i.e. on the basis of a legitimate interest as described above), unless STF is permitted to use such personal data for any other purpose set out in this Privacy Policy or STF identifies and can demonstrate a compelling legitimate interest in the further processing of your personal data.

C. Where does the STF use my personal data on the basis of my consent (basis consent according to Art. 6 para. 1 letter a DSGVO)?

In the following cases, STF will only use your personal data as described below if you have given your prior consent to the processing operations in question.

Transfer of your personal data to other companies within the STF Group:

STF may transfer your personal data to other companies of the STF Group. An up-to-date list of the STF Group companies can be found in Section A under Responsible parties. In the event of a transfer, these companies will use your personal data for the same purposes and under the same conditions as described in sections B and C.

Inclusion in a pool of applicants or freelancers: Once your consent has been obtained, your data will be stored in a pool. The storage takes place for a period of 2 years from receipt of your declaration of consent.  After expiry of this period, your data will be deleted in accordance with data protection laws.

Revocation of a given consent:

You can revoke your consent to the processing of your personal data at any time and free of charge at: datenschutz@stf-gruppe.de . This also applies to the revocation of declarations of consent given to us before the EU Data Protection Basic Regulation came into force, i.e. before 25 May 2018.  In the event of revocation, STF will not process the personal data to which the consent applied unless STF is legally obliged to do so. If STF is required by law to retain your personal data, the further processing of your personal data will be limited accordingly and the data will only be retained for the legally required retention period. However, the revocation has no effect on the past processing of personal data by STF until the time of revocation. We would like to point out that even if you revoke your consent, we may be able to continue data processing, possibly to a reduced extent, under certain circumstances on the basis of a statutory authorisation.

The following application data is collected and processed as part of the online application using the application form:

If you would like to apply online via STF FasTTrack to STF Placement GmbH, we need the URL to your social media profile and your consent to contact you via the social network you have selected.

The following application data is collected and processed as part of the online application using a social media profile:

  • Link to your profile of the social network transmitted to us
    Information about you that is stored in your social media profile. These details vary from user to user and are also dependent on the selected social network.

The following data can therefore be collected:

  • sex
  • title
  • first name
  • Surname
  • nickname
  • Street and house number
  • Postcode and city
  • email address
  • Telephone/mobile number
  • Information on profession and training
